AgileEngine, LLC, a privately held company headquartered in the Miami, Florida area and established in 2000 (“AgileEngine” or “company” or “we” or “us” or “our”). As a software company, we are committed to protecting the privacy of our candidates, clients, and users of our Websites.

This Privacy Policy explains what we do with your personal information, whether we are in the process of introducing ourselves to you, contracting your services, providing you with our services, or when you are visiting our website www.agileengine.com and all its subdomains, including any other media form, media channel, mobile website, or mobile application related or connected thereto, (collectively, the “Site” or “Websites”) or the LaunchPod platform. We may update this policy periodically to reflect legal, regulatory, or company changes. Any updates will take effect immediately upon posting. What kind of Personal Information do we Collect?

To carry out its core business activities, AgileEngine collects a range of personal and other information concerning website and application users, prospective and placed candidates, contractors, clients, service providers, employees, and consultants.

AgileEngine collects data from website visits, which may include traffic and location information, weblogs, referral sources, user login details, and accessed resources. The company also processes information automatically gathered by its servers, such as browser and device details, IP address, access times, and viewed pages. If a user accesses the site via a mobile device, device ID, model, manufacturer, and location data may also be collected. Additional information may be obtained from third parties when accounts are linked and permission is granted.

AgileEngine also processes information provided by candidates and contractors when applying for roles through job sites, email, interviews, or platforms like LaunchPod. This may be supplemented with data from publicly available sources such as LinkedIn, as well as referrals from other candidates, clients, or employers. Additional data may come from third-party platforms—including aptitude testing tools, educational institutions, former employers, and clients involved in the recruitment process.

The personal information collected may include names, personal and online identifiers (such as IP addresses or account usernames), contact details (including email, phone number, and home address), date of birth, qualifications, employment history, job titles, compensation and benefits, academic records, references, resumes, and professional communications conducted via AgileEngine’s networks. When interviews are conducted using LaunchPod’s video recording feature, video content may also be processed. With consent, AgileEngine may generate AI-assisted interview notes, which involves recording the interview session. Records of correspondence with individuals may also be maintained.

Where permitted by law, AgileEngine may collect Special Categories of Personal Information or other sensitive information such as gender, health status, race, or ethnicity for purposes including equal opportunity monitoring or where required for specific roles. Criminal background data may also be processed if relevant to a position or requested by a client.

AgileEngine processes the names, contact information, job roles, and responsibilities of potential and existing client representatives to manage and maintain business relationships, including for the promotion of products and services. Communications with client representatives may also be retained.

AgileEngine may use personal contact details to share information about events, promotions, or other marketing content. For those participating in company events, contact details may be used for coordination. Photographs may also be taken during such events and used in promotional, marketing, or documentation materials.

AgileEngine analyzes usage trends and user behavior to improve its Websites and services. This analysis supports marketing research, the delivery of updates and promotional content, targeted advertising, and the creation of personalized profiles for future visits. AgileEngine collects personal information from prospective and placed candidates and contractors in several situations. This includes when individuals apply through the LaunchPod platform or by other means, providing data directly or via third-party sources like LinkedIn. Their information may be considered for the specific role they applied for, or, with their consent, for other positions within the broader talent pool. Personal information is also collected when candidates are matched to job openings at AgileEngine or its clients, when they share identifiable information in chat conversations relevant to the hiring process, and during other communications with AgileEngine throughout recruitment.

In addition to candidate data, AgileEngine processes personal information related to clients, suppliers, and their business representatives. This is necessary for delivering and promoting services, as well as fulfilling contractual obligations.

Where individuals have provided consent for marketing, AgileEngine may use their personal information—such as names and email addresses—to share information about events, promotional campaigns, and special offers. Depending on the individual’s consent and AgileEngine’s legitimate business interests, this information may also be used to help organize and coordinate marketing activities and events.

Personal information may also be processed when necessary to establish, exercise, or defend legal claims.

What is our Legal Basis for Personal Information Processing?

AgileEngine relies on legitimate interests as a lawful basis for processing personal information, provided these interests do not override the rights and freedoms of individuals. These legitimate interests include improving and enhancing services, including Websites, recruiting staff for AgileEngine’s internal operations and facilitating the exchange of personal information between contractors and client contacts—an essential component of delivering software services.

Legitimate interest also applies when AgileEngine contacts potential clients or their representatives to inform them about new products and services. Similarly, personal information may be processed when necessary to assert or defend against legal claims.

When a candidate applies for a position—whether directly or through third-party platforms such as LinkedIn, LaunchPod, or by submitting a resume—AgileEngine relies on the candidate’s freely given consent obtained during the application process. This consent allows AgileEngine to process the individual’s data for recruitment purposes, both for the specific job applied for and, if agreed, for future opportunities or inclusion in the AgileEngine talent pool. Candidates may withdraw their consent at any time; such withdrawal does not affect the lawfulness of any processing carried out before it was withdrawn.

AgileEngine may also process personal information to comply with legal or regulatory obligations.

Additionally, where it is necessary to fulfill contractual obligations with a data subject, AgileEngine will process personal information based on the performance of a contract. This legal basis applies across the full contract lifecycle, including pre-contract discussions, contract execution, and termination.

With whom do we share Personal Information?

AgileEngine may share personal information with its affiliates, including subsidiaries, joint venture partners, and other entities under common ownership or control. All affiliates are required to handle personal information in accordance with this Privacy Policy.

Personal information may also be disclosed when required by law to comply with applicable legal obligations, governmental requests, judicial proceedings, court orders, or other legal processes. If a candidate or contractor has applied for—or consented to be considered for—a role with a client, AgileEngine may share their personal information with the relevant client. This is necessary to support software service activities, such as evaluating qualifications, coordinating communication, scheduling interviews, and providing updates during the hiring process.

AgileEngine may also share personal information with authorized third-party service providers who process information on AgileEngine’s behalf, strictly in accordance with instructions and applicable legal requirements. Generally, AgileEngine does not sell, rent, or otherwise disclose personal information to third parties. However, as part of its global operations and commitment to employment branding and career development, AgileEngine may transfer personal information to subsidiaries, affiliates, or trusted business partners who process data in compliance with legal and contractual obligations.

Where and for how long do we store Personal Information?

Personal information is primarily processed in the United States, where AgileEngine is headquartered. As a general rule, AgileEngine does not process the personal information of individuals residing in other countries unless it is necessary to fulfill a specific business purpose. In case of individuals residing in the European Economic Area (EEA), AgileEngine relies on the European Commission’s adequacy decision concerning the United States or, where required, on appropriate safeguards to ensure compliance with EU data protection standards.

We retain personal information only for as long as necessary to fulfill the purposes for which it was collected. The specific retention period may vary depending on the nature of the information and the reasons for its collection. Personal information is also retained as needed to comply with legal, accounting, or regulatory obligations. In addition, we may keep certain information for longer periods to preserve historical records or to address potential legal claims, in line with industry practices and applicable regulatory requirements.

If you have chosen to be part of our talent pool, we will store your data until you withdraw your consent. You can do so at any time using the appropriate option available in LaunchPod.

AgileEngine has implemented appropriate technical and organizational measures to ensure the security of all personal information, including safeguards designed to prevent accidental loss, unauthorized access, or misuse. Access to personal information is restricted to individuals who have a legitimate business need, and those handling such data are authorized to do so only under strict confidentiality obligations.

AgileEngine has also established procedures for responding to suspected data security incidents. Where required by law, we will notify affected individuals and the relevant regulatory authorities of any confirmed breaches.

Please be aware that while we make every effort to protect your personal information, no method of transmission over the internet is completely secure. As such, any transmission of data via online channels is done at your own risk.

Subject to certain limitations under California law, California residents have the right to request (1) a list of specific categories of personal information we have disclosed to third parties for their direct marketing purposes during the preceding calendar year, and (2) the identities of those third parties. Children’s Privacy

The AgileEngine’s Websites and services are not intended for use by individuals under the age of 16. If you are under 16 years old, please do not access, use, or register on the Site. We do not knowingly collect personal information from individuals under the age of 16. If we discover that we have inadvertently collected such information without prior parental consent, we will promptly terminate and delete the associated account and all related data.
